    Nook Privacy Policy

    Homebase Automation, LLC dba NOOK ("NOOK", "us" or "we") is an innovative solution to your home renovation needs. We streamline the process of achieving the home of your dreams—right at your fingertips. To do that, we gather and store important information relating to you and your household, including personal information. We share that information with third-party service providers who process your data on our behalf to help run our business, under stringent contractual provisions that protect your personal information. However, NOOK will never share your personal information with an unaffiliated third party without your express permission.


    Purpose and Scope

    This Privacy Policy is meant to help you understand how we and our affiliates collect, secure, use, and disclose your personal information in connection with our services. This Privacy Policy applies to information we collect from you and from third parties, both online and off, whether you access us via our websites or other electronic means, including Android and iOS mobile apps.

    By accessing or using the BuiltwithNook or Nook-Pro website, or otherwise providing us with personal information, you agree to the terms and conditions of this Privacy Policy and any updates we make to it. So please read this Privacy Policy carefully, because if you disagree with any of it, then you do not have our permission to access or use our websites. If you choose to limit the information that you provide to us while using the websites, please understand that certain functionalities may be unavailable to you.

    We collect both personally identifiable information and non-personally identifiable information about you and your property to help you use our services.

    Information You Provide

    NOOK collects information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("Personal Information").

    You provide Personal Information to us in numerous ways, including, but not limited to:

    • register to use our websites

    • upload documents to our websites

    • provide feedback to us

    • transfer funds using our services

    • sign up to receive emails or texts

    • participate in sweepstakes or promotions

    NOOK and third party providers may automatically collect data about you when you use our websites or third party websites or services. This information is primarily needed to maintain the security and operation of our services, and for our internal analytics so that we can improve our products and services. This information does not reveal your specific identity (like your name or contact information) but may include:

    • device and usage information, such as your IP address

    • browser and device characteristics

    • operating system

    • language preferences

    • referring URLs

    • device name

    • country or location

    • information about how and when you use our services


    Nook Use Of Information

    NOOK uses your information in various ways, including:

    • processing your data to find and recommend relevant contractors, mortgage brokers, and vendors

    • personalizing information we send to you, including targeted advertising based on your needs and interests

    • processing your orders

    • quality control: specifically, NOOK records and monitors customer service calls and records to ensure we are providing you with the highest quality of service

    • responding to your questions

    • identifying you

    • communicating with you about your account, our services, and making announcements like changes to our Privacy Policy

    • complying with the law and legal requirements, including valid court orders

    • designing, improving, and administering our services

    • for any other purpose if we anonymize the data such that it no longer reasonably identifies you or your household


    Sharing Your Information

    NOOK only shares your personal information with unaffiliated third parties when you give prior consent to do so or when required by law. When NOOK shares your personal information with service providers who act on our behalf ("affiliated third parties"), we require them to adhere to same level of security and confidentiality that we maintain.

    NOOK may share your information without your prior consent as follows:

    • with certain providers, for example, when you direct us to coordinate with potential contractors to perform work

    • for commercial purposes with our service providers, business affiliates, and vendors contracted to do business on our behalf, for example, with vendors who send emails for us, operate our websites, serve ads on our behalf, or run promotions for us

    • with our affiliates for joint marketing initiatives

    • when we deem it necessary to protect the security and reliability of NOOK and/or its websites

    • with any successor to all or part of our business

    • with any person performing audit, operational, legal, or other similar services for NOOK

    • when required to do so by subpoena, court order, or other legal enforcement


    Safeguarding Your Information

    NOOK values your privacy and is committed to protecting your information. We have appropriate administrative, technical, and physical safeguards in place to ensure the integrity and security of your information. This includes having comprehensive security policies and procedures, testing and monitoring vulnerabilities, and performing risk assessments of NOOK and our vendors.     Your Choices About Your Information

    You have choices about how we use your information. Please understand that if you choose not to disclose information to us, it may affect your ability to use some features of our services or products.

    Marketing

    You can opt out of our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by selecting your marketing preferences in your account settings. Please note that even after removing you from our marketing lists, we may still send you non-promotional communications, such as responding to service requests.

    Cookies

    Most web browsers are set to accept cookies by default. You can choose to set your browser to remove or reject cookies. Doing so could affect certain features or services of NOOK. To opt out of interest-based advertising by advertisers of our services, visit http://www.aboutads.info/choices/.

    California Residents' Privacy Rights

    If you are a California resident, you have specific rights under the "Shine the Light" Law and the California Consumer Privacy Act. The California Code of Regulations defines a "resident" as:

    • every individual who is in the State of California for other than a temporary or transitory purpose, and

    • every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose

    All other individuals are defined as "non-residents." If this definition of "resident" applies to you, then we must adhere to certain rights and obligations regarding your Personal Information.

    "Shine the Light" Law

    California Civil Code Section 1798.83, also known as the "Shine the Light" law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about the personal information we shared (if any) with other businesses for direct marketing purposes, as well as the names and addresses of all third parties with whom we shared your Personal Information in the immediately preceding calendar year.

    The California Consumer Privacy Act

    The California Consumer Privacy Act ("CCPA") is a law designed to enhance the privacy rights of California residents. CCPA applies to certain companies that do business in California. It gives residents certain rights regarding the Personal Information businesses collect about them. This includes the right to request disclosure, access, or deletion of your Personal Information, the right to direct a business to stop selling your Personal Information, and the right to non-discrimination upon exercising your rights. Please know that NOOK does not sell your Personal Information.

    The Right to Request Disclosure

    California residents have the right to ask NOOK to disclose the categories and specific pieces of personal information that we have collected about you in the previous 12 months (and still retain). If you would like to exercise your right to request disclosure, please submit your request in writing by emailing us (please state "Right to Request Disclosure" in your subject line) at PrivacyOfficer@builtwithnook.com

    Upon authenticating your identity and that the request is reasonable, we will provide you with this information in writing, free of charge, within 45 days of receipt of your request. Or, if reasonably necessary (and upon notice to you), within 90 days. If applicable, we will also disclose:

    • the categories of sources from which NOOK collected the Personal Information

    • the business or commercial purpose for collecting or selling Personal Information

    • the categories of service providers with whom we share Personal Information

    The Right to Request Deletion

    You can ask us to delete your Personal Information. If you do, we will respect your request and delete the information, subject to certain exceptions provided by law, such as the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

    If you would like to exercise your right to request deletion, please submit your request in writing by emailing us (please state "Request Personal Information Deletion" in your subject line) at PrivacyOfficer@builtwithnook.com. Upon authenticating your identity, and reconfirming that you want your information deleted, we will respond within 45 days of receipt of your request. Or, if reasonably necessary (and upon notice to you), within 90 days.

    The Right to Opt Out of the Sale of Personal Information

    NOOK does not sell your personal information.

    Right to Non-Discrimination

    NOOK will not discriminate against you (e.g., through denying services or providing a different level or quality of goods or services) for exercising any of the rights afforded to you.

    Third Party Sign On

    We allow you to register for and access our websites using third-party sign-on with Google and Facebook. NOOK is not responsible for the privacy, practices, or actions of these companies when facilitating this authentication protocol.

    Links To Other Websites

    Our websites may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us—and which may link to other websites, services, or applications. Please be aware that NOOK is not responsible for the privacy or practices of other websites. We do not make any guarantee regarding those third-party websites, services, or applications, and we are not liable for any loss or damage caused by the use of such sites. Any data collected by third parties is not covered by this Privacy Policy. You should review the policies of the third parties and contact them directly if you have any questions about their services.

    Do Not Track Disclosure

    Many web browsers offer a Do-Not-Track ("DNT") feature, allowing users to indicate their preference not to have their online browsing activities monitored or collected. NOOK respects this DNT signal and refrains from collecting telemetry data when you enable this setting in your browser.

    Information Retention

    We will only keep your personal information for as long as necessary to fulfill the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this policy will require us to keep your personal information for longer than six (6) months past the termination of the user's account.

    When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize your information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

    Information From Minors

    NOOK's platform is not intended for children under 13 years of age. NOOK does not knowingly solicit data from or market to children under 13 years of age. By using the services, you represent that you are at least 13 or that you are the parent or guardian of a minor and consent to the minor's use of the services. If we learn that personal information from users less than 13 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.     Changes To This Privacy Policy

    We may update this Privacy Policy from time to time. If we do, we may notify you either by prominently posting a notice of such changes on our websites or by directly sending you a notification. We encourage you to periodically check for updates and changes to this Privacy Policy because your use of our services after the updates have been made, and we have notified you as required by law, constitutes your acceptance of its terms—even if you have not reviewed the updates. Any updated version will be indicated by a new "Revised" date and the updated version will be effective as soon as it is accessible.
